Our client, a 76 year old married, retired dressmaker, was walking back from the supermarket on Avenue I in Brooklyn with her aide who was pushing a shopping cart.
At the same time, Approved Oil Co. of Brooklyn, Inc. was delivering oil to a building when our client tripped and fell over the oil hose that was connected from the truck to the building.
There were no “caution” signs or other warnings of any kind where the hose was along the sidewalk.
After our client fell an ambulance arrived and she was taken to the ER as both of her eyes and her entire face was and she had a laceration to her chin and inside her lower lip which both required stitches.
