NYC Streets Honors BLG Client

Blitz Law Group, LLP Secures $500,000 Settlement in Bicycle Accident Case Against MTA

 

Blitz Law Group, LLP is proud to announce the successful resolution of our client’s case, for $500,000, for when he was cycling in Manhattan and was hit by a bus. Our client, 55-years old, was riding his bicycle on 26th Street, between Park and Madison Avenue, in August of 2018, when he was struck by a New York City bus operated by the MTA.

Initially, the bus responsible for the collision remained unidentified. However, the Blitz Law Group conducted an extensive investigation and uncovered video footage of the crash from a witness that enabled us to accurately identify the bus and its driver.

Our client suffered severe injuries in the collision, including a rotator cuff tear and a humerus fracture in the shoulder. These injuries necessitated a surgery involving an Open Reduction Internal Fixation procedure, where plates and screws were inserted, and the rotator cuff tear was repaired using fiber-wire technology.

Blitz Law Group, LLP swiftly filed a lawsuit against the MTA, initiating a multi-year legal battle. Throughout the litigation process, our dedicated attorneys conducted numerous depositions while the defendants consistently denied responsibility for the accident.

As the trial was poised to begin with jury selection, Justin Blitz, achieved a favorable settlement of $500,000. This significant outcome not only provides our client with long-awaited justice but also acknowledges the physical and emotional toll he endured due to the accident.

Justin Blitz Settles Westchester case for $4.3 Million for Laborer who Fell from a Ladder


In April of 2023, in a case where Justin Blitz was retained to be the trial attorney, a settlement was reached for $4.3 million on the eve of trial. An iron worker fell from a ladder and sustained permanent injuries that prevented him from working again. Our client sustained an injury to his neck during the fall and had to undergo fusion surgery because of the injury.

The trial and negotiations that led to the settlement took place in the Supreme Court of Westchester County. After multiple attempts at mediation failed, the case was prepared by Mr. Blitz to begin trial. After extensive negotiations at the last minute, Mr. Blitz was able to settle the matter for $4.3 million.

Blitz Law Group, LLP Secures $3.75 Million Settlement in Tragic Case


Blitz Law Group, LLP is pleased to announce the successful settlement of our client’s case for $3.75 million. This case centered around the medical treatment received by a cherished member of the Far Rockaway community known for his vibrant personality and numerous talents.

Our client was a devoted father, skilled basketball player, and passionate musician and entrepreneur.  In February of 2018, our client, who was 28 years old at the time, sought medical attention for asthma symptoms at a hospital in Queens.  Despite receiving several treatments, his vital signs rapidly declined, leading to the decision to perform an endotracheal intubation to assist with his breathing.

During intubation, complications occurred, and subsequent chest X-rays showed that the endotracheal tube was improperly placed. It is necessary fora physician to insert an endotracheal tube through the larynx.

Unfortunately, our client’s physician inserted the tube through his esophagus, causing him to lose carbon dioxide to his brain. Despite efforts to stabilize him, our client tragically passed away days later.

The Blitz Law Group filed a lawsuit against the hospital, the physician who improperly inserted the tube, and the radiologist who read the original x-ray wrong and reported that the tube was correctly inserted.  

During the legal process, it was discovered that our client had been treated in a manner that was contrary to the standard of care.  As part of our claims of malpractice, we alleged that the endotracheal tube was placed incorrectly, and that the subsequent chest x-ray was read incorrectly.

Over the course of three years, Justin Blitz litigated the case, taking ten depositions, and successfully defending various motions.

In a mediation just before trial, a settlement of $3.75 million was reached, which provides our client’s family with the resources they need to move forward while keeping his memory alive.

Whatever happened to that late-June incident at the Goop shop in Sag Harbor, where two waiters were badly burned after a store employee toasted marshmallows for an event, using isopropyl alcohol?

It’s not in litigation, at least not yet. Lawyers for both sides are trying to negotiate a settlement.

Justin Blitz, the New York City-based lawyer for the two men, Mark Nilon and Nathaniel Meeks, says that while his clients have since gone back to work, each was badly burned in the June 25 incident.

That evening, the Goop retail store, founded by the actress Gwyneth Paltrow and headquartered in Santa Monica, Calif., hosted an event at its Bay Street shop, catered by Little Gem, which is owned by Mr. Blitz’s wife. (The catering company is not involved in the settlement discussions, the lawyer said.)

Little Gem provided the food and the waiters. Unknown to the two men, said Mr. Blitz, Goop, on its own, had set up a s’mores buffet, with a burner in a covered area outside.

According to police and fire marshal reports, a shop employee used rubbing alcohol to “kindle” the fire, and the vapors caused an explosion. Sag Harbor Fire Marshal Bruce Schiavoni cited Goop on a certificate of occupancy charge, and for lighting a flame underneath a flammable ceiling — in this case, a woven bamboo ceiling that was burned in the explosion.

Mr. Meeks was helicoptered to Stony Brook Hospital for burns on his back and hands; Mr. Nilon was taken to Stony Brook Southampton Hospital with facial burns. Police reported that “subjects stated that rubbing alcohol was added to candles, which caused a large explosion/fire.”

In the months that followed, said Mr. Blitz, both men paid follow-up visits to a number of doctors.

The lawyer said he was hopeful that the shop and the waiters will arrive at an amicable resolution of the case. Failing that, “the ultimate next step would be proceeding with litigation.”

An email sent to Goop’s corporate office for comment on the case did not receive an immediate response.

There is no doubt that Double Jeopardy is a very significant part of the legal system. When a court makes a decision, it allows what that court decided to stand in the same manner that respect is given to that court. 

The concept of Double Jeopardy does not apply to every crime and the process of Double Jeopardy does not begin immediately. If, for example, you are accused of committing a crime and accept a plea deal, then you are not subjected to Double Jeopardy. You cannot be tried for that offense if you have been accused of a crime, entered a plea, and the courts accept your plea.

You can only use double jeopardy once. As a result, certain evidence that was used in a prior case can no longer be used in a new trial as well. This is true for things that may have been used in the previous trial. Should you be guilty or innocent, you may think that double jeopardy would be a great thing for you. However, it is very complicated, and it is not a good idea to rely on the Internet to educate you about it. $400,000 for pedestrian struck by bicycle delivery boy


Our client, a retired physician, was a pedestrian in Manhattan. She was waiting to cross the street when she was struck by a delivery boy for a restaurant who was traveling in the opposite direction of traffic on a bicycle.

As a result, she sustained multiple facial fractures, including fractures to her maxillary bones, nasal bones and pterygoid plates. She required surgery, which included the implantation of hardware into her face to correct the fractures. She has permanent bilateral partial paresthesia of the second division of the trigeminal nerve as well as a malocclusion. The case was settled by Fred Schulman, Esq. for $400,000 at a mediation shortly before trial.

After many years of engaging in extensive delay tactics and denying responsibility, the insurance company for the restaurant ultimately admitted that their delivery person was riding his bicycle in a dangerous and negligent manner and paid the settlement.
